A Lawsuit against a growing company by the prototypical monster company Google Inc has come to close over a dispute over the domain names androidtv.com and xbmcandroidtv.com. Androidtv.com provides media content over their platform, Hollywood-centric video graphic services, celebrity news, and the promotion of a set top box employing the android platform, which Google permits the public to do. November 2006, Mr. Escovar (partner in Androidtv.com) registered his domain name, and at that point Google did not use the term “android” in any commercial sense. Google did not seek federal trademark protection for ANDROID until October, 31, 2007, almost a year later. Even then it was filed as an intent-to-use application. Between November of 2006 and October of 2007, Google did not use the word “android” in any commercial or trademark form; and Google has not submitted any evidence showing otherwise. Thus, as between Mr. Escovar and Google, Mr. Escovar came first. With the win for AndroidTV.com and its services ensure the safe growth of their concept.
